By using or submitting an order on this website, you are agreeing to the terms that appear below. So please read the below terms and conditions carefully.
To register with tizardin.mu you must be 18 years of age or over.
1. Purchase Contract
1.1 This website is operated by tizardin.mu . ("we", "us" or "our"), BRN 107024772. By using tizardin.mu website you are bound by these Terms & Conditions. If you use or order plants or items after we have published any changes you will be bound by those changes. Accordingly, you should check prior to each use or order to ensure that you understand the precise Terms & Conditions.
1.2 We sell items(Authorized local Plants, organic, vegetable, Bio fertilizes and all items related to gardening sections only to end-users.
1.3 We will confirm your order whether placed directly by using tizardin.mu website or as a result of you calling our Team. This will occur either by message on the website immediately after you have confirmed your order, or by sending an email to the email address you have provided to us.
1.4 Please note that the order confirmation does not constitute our acceptance of your order. Subject to our cancellation rights in clause 11, acceptance of your order and completion of the contract will take place when we dispatch the item to you.
1.5 You must be 18 years old or over and must have completed the registration process in order to participate in our service.
2. Cart update
2.1 (a) With the exception of item referred to in clauses 2.1(b), but including items from our partner and other nursery that are subject only to any inadvertent technical error for which we will not be liable. If you subsequently amend your order to add items, the prices charged for new products which were not in your original order will be the prices quoted at the time you confirm your amended order. However, if you add more of the same items which were in you original order, the prices charged for these items will be the prices quoted at the time you confirmed your original order. Please note that as promotions are offered for a limited period of time subsequent amendments to your order means that certain promotions are no longer being offered.
2.1 (b) Where items are listed as ''Out of stock' customers will not be able to add item to cart. Customer can instead make a reservation by listing their wanted items on the Contact Us page and list the concern item(s) for reservations.
2.2 Each order you make may exclude a charge for delivery. If your delivery is subject to a delivery charge, it will be shown to you as a separate charge on the delivery confirmation page before you confirm your order. See our delivery section for more information.
2.3 Plant& Animal-care, Please read or do researches on plant(s) that are unknown to you before ordering, please note that some kind of plants are poisonous and toxic to cats and dogs. tizardin.mu expressly disclaim all kind of accusations or responsibilities, relevant to your animal(s), harms or all kind of accusation in relation to the subject.
2.4 The government introduced regulations on banning plastic bags ("sacs de caisse, roll-on bags, etc"), meaning that when we deliver your product, items will either be delivered in eco-friendly plant bag (eg biodegradable bags, paper bags, carton boxes), or free of packaging where applicable.
VAT are calculated automatically at the checkout of your order. Vat are *inclusive on some's items only. Therefore most items may be subject to VAT *exclusive as we work with Suppliers, Partners. VAT are calculated automatically 15% relevant to local law of Mauritius.
3. Forms of Payment
Payments can only be made in advance by bank transfer internet banking. We encourage you to pay for your order directly after placing your order(s) to ensure timely processing & on-time delivery. Please note that unpaid orders will not get process, thus not added to delivery schedule. Refer to our Bank detail page for more information.
4.1 Delivery availability will be specified on the delivery product page on the website and will be made to the address specified by you when you register on the website. You have the ability to change this address while processing your order or directly chose from information page while ordering and you must do so if you move home so that we can deliver to the correct address.
4.2 Products are subject to availability and prevailing market conditions. We may limit the quantities of items (particularly items on special offer) supplied to any one customer if in our opinion the quantity ordered jeopardizes availability for other customers. You can make ask for your reservation on our contact page.
4.3 We will always try to supply you with the full quantity that you have ordered. If you are not satisfied with the quality you have received, In the event that the items delivered to you are incomplete or include incorrect items, you must notify us promptly or within 1 hour. We may ask you to send us a photo as proof for confirmation. Please refer to our refund policy page.
4.4 We take special care to endeavor that deliveries are made within a short delivery slot and accordingly, it is your responsibility to ensure that an appropriate person is available on delivery. If no one is at the address when the delivery is attempted the item(s) will be retained by us. We will leave notification of delivery and will telephone to attempt to rearrange the delivery. In case of re-delivery, additional delivery fee will apply on your behalf. Please refer to our refund policy or delivery policy pages.
4.5 Please note adverse weather conditions or other events outside of our reasonable control may result in the occasional late or canceled delivery. If that is the case we will endeavor to contact you as soon as we are able to reschedule your delivery date availability. In any event, subject to clause 7.1 below, our liability to you will be limited to the price of items not delivered and the cost of delivery. (Refer to delivery or refund policy)
4.6 Should you fail to be present for your delivery we are entitled to charge you the delivery fee.
4.7 tizardin.mu will ordinarily only make deliveries when an appropriate person is able to receive the order. In the event that you instruct tizardin.mu to leave the order unattended at your address, tizardin.mu expressly disclaims all liability which may arise by virtue of the item(s) being left unattended for a period of time.
4.8 tizardin.mu will not leave items unattended at your doorstep, you or a person authorized by you must be present upon delivery of your order. Please refer to our delivery policy page.
4.9 Deliveries are limited to one delivery per day per household.
5. Defect / incomplete / incorrect items
5.1 We guarantee the quality of our item(s). You must inspect the plant(s) and notify us promptly by SMS or by phoning our Team on +230 52555061 or 52542667. If your request get approved, proof may be asked, we shall proceed with a refund of the price of any item that do not meet with your reasonable satisfaction or arrange for the delivery of replacement item providing that you notify us within 1 hour of delivery of the item. *Subject to availability. 5.2 Subject to clause 7.1 below, we will not accept any further claims for loss from or in connection with the partner/supplier of faulty item, whether direct, indirect, consequential or otherwise, howsoever arising.
6. Amendment of Orders and Cancellation Rights
6.1 Order(s) can only be amended or cancelled by calling our Team on +230 52555061 or 52542667, or emailing us on email@example.com. Please note that orders cannot be amended or cancelled more than 24 hours before the scheduled delivery slot. Refer to our refund policy page.
7. Warranty & Liability
7.1 In addition to paragraph 4.4, we will not be deemed to be in breach of contract of of these Terms & Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment, road traffic problems.
8.1 To help us ensure the best possible service some telephone calls may recorded.
8.2 In assessing your request for delivery of items from us, we may make inquiries about you, including searching your records, held by your account rating agencies or similar organizations.
8.3 We respect your privacy. The personal information that you give us is held with care and security. We do not sell, rent or transfer this information to third parties for their marketing purposes. We will share your personal information only with other businesses partners.
8.4 At the time of your registration you will be required to create a password. Please keep this secret, as you are entirely responsible, if you do no maintain the confidentiality of your password. You are entirely responsible for all orders placed with us. You must immediately notify us of any unauthorized use of your email address and/or password or any breach of security known to you.
